‘NO HONEST OPERATOR WOULD EVER DREAM OF DEPLOYING’ — CELSIUS ESTATE BILLS BITMEX FOR 6,360 BITCOIN ELEVEN DAYS BEFORE THE DOORS SHUT

Eleven days before the doors shut, a bill arrives. On September 12, 2026, the Celsius estate’s recovery manager, BRIC, sued five BitMEX companies in New York bankruptcy court over two liquidations on March 12 and 13, 2020. It asks for “at least 6,360.1666 BTC” or its worth “at current BTC value.” No dollar figure is in the complaint; the outlets did that math. The complaint says BitMEX’s own trading desk had “what others have referred to as ‘God Access’” to customer positions, and says so “on information and belief,” which is suspicion, not proof. BitMEX says it closes September 23, 2026 at 04:00 UTC and that “all assets exceed liabilities.” Customer balances are a debt BitMEX owes. A judgment lands on HDR’s own pot, and the complaint points at the Insurance Fund, which it says grew by 4,457 XBT over those two days. The calendar is the tell: a standstill with HDR on March 9, 2026, HDR’s closure notice on July 23, the suit in September. A standstill is worth something while the other side stands still. Once the counterparty is packing up, the clock on the pot runs faster than the clock on the claim. The plainest line in the filing: Celsius sent 350 BTC of collateral, BitMEX emailed at about 23:52 UTC that it saw the deposit, the position was liquidated at 23:54, and the deposit confirmed at 23:55. That is the complaint’s clock, not a court’s finding. At the time of this writing, bitcoin was $76,239.
