THE CFTC CITES SATOSHI’S WHITE PAPER — THEN ASKS HOW TO POLICE LEVERAGED CRYPTO TRADING — IT’S A LIST OF QUESTIONS, NOT A RULE YET
The CFTC opened a rulemaking on October 5, 2026, but read the label. It is an advance notice of proposed rulemaking: a request for comment, the step before a proposed rule. It names two ideas, Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets, a new kind of registered exchange "purpose-built" for these trades. Comments are due 60 days after it runs in the Federal Register.
The trades in question are retail ones done "on a leveraged or margined basis, or financed" by the seller or someone working with it. That is the existing statute's definition, not a new one. CoinDesk calls the package proposed rules. The document calls itself an advance notice, and it asks questions instead of writing rule text.
The notice cites Satoshi Nakamoto's white paper by name and quotes a former chairman: "bitcoin is a commodity." What it does not reach is the plain trade. Buy bitcoin with your own money, no loan and no margin, and by the statute's own words it is not one of these transactions.
What you can check: the definition, which fits in one sentence. What is still open: every answer, since nothing has been proposed yet. At the time of this writing, bitcoin was $85,412.
