THAILAND'S SEC CLEARS BITCOIN AND ETHER ETFS FROM OCTOBER 16, 2026 — THE COINS MUST SIT WITH CUSTODIANS THE THAI SEC LICENSES — FOREIGN CUSTODIANS ARE SHUT OUT FOR NOW
On October 8, 2026, Thailand's Securities and Exchange Commission issued rules for crypto exchange-traded funds that take effect on October 16, 2026. In the first stage only bitcoin and ether qualify. The funds trade only on the Stock Exchange of Thailand, and brokers may not lend on margin to buy them.
Most coverage led with the open door. The custody line matters more. The SEC release says crypto ETFs "must be safeguarded only by DA custodians regulated by the SEC." Custody done directly or handed to a sub-custodian "must be performed by a licensed DA custodian." A foreign custodian is not allowed for now. The SEC says it may permit one later if it meets the SEC's tests.
In plain terms, every bitcoin behind a Thai ETF will sit with a firm that holds a Thai license and answers to the Thai SEC. The same release keeps ordinary Thai clients away from foreign crypto ETFs and blocks receipts that reference them. Thai savers get one road into bitcoin funds, and it runs through Thai vaults.
An ETF share is a claim on coins someone else holds. That has not changed. What changed is who holds them and which regulator can reach them. If you want bitcoin that no regulator can freeze, hold your own keys. At the time of this writing, bitcoin was $82,965.
